Terms and Conditions

  1. Overview.

    Under this FNET Fiber Testing Solutions Promo (the “Program” or “Promotion”), during the period February 17, 2023, and July 31, 2023 (the “Program Period”), get a Fluke Networks FiberLert™ Fiber Light Detector (‘Gift’) when you complete a demonstration with a Fluke Networks specialist within the Program Period (“Demo”). Additionally, you are eligible for a cash rebate (‘Cash Rebate’) when you purchase a qualifying Fluke Networks product listed in table in para 4 (B) (“Qualifying Purchase”) from a participating authorized Fluke Networks distributor/reseller in the European Union, United Kingdom, Norway, Switzerland (excluding Hungary, and any country where cashback or cash rebate promotions are prohibited, or to which EU or US trade sanctions currently apply). (“Sponsor” or “Fluke Networks”).

    A Qualifying Purchase must be made during the Program Period, meaning between February 17, 2023, and July 31, 2023. The offer available under the Program may not be combined with any other offer or redeemed for alternate products, services, cash, or credits except as expressly authorized in these Terms and Conditions.

  2. Eligibility.

    The Promotion is void where prohibited by law and open only to end customers based in European Union, United Kingdom, Norway, Switzerland (excluding Hungary, and any country where cashback or cash rebate promotions are prohibited, or any country to which EU or US trade sanctions currently apply) (“Program Territory”) . Customers who are private individuals should be of legal age and have capacity to contract.

    Employees, directors and officers of Sponsor, its parent companies, affiliated companies, subsidiaries, (sub-) distributors, agents, resellers, representatives, public relations, advertising, promotion and fulfillment agencies, professional advisors, consultants, website providers, web masters and those persons’ immediate families (parents, siblings, children and spouse, wherever they may live) and persons living in the same household (whether related or not) are not eligible to participate in the Promotion. This Promotion is also not applicable to any government official, government employee, or employee of any company owned (in full or in part) by a government, political party, political party official, or candidate for any government office or political party office; and any healthcare professionals, being (a) individuals (or entities) involved in the provision of health care services to patients, or (b) individuals (or entities) who purchase, lease, recommend, use, arrange for the purchase or lease of, or prescribe Sponsor’s medical products or services on behalf of health care professionals, including physicians’ purchasing agents, physicians’ practice managers and management within medical group purchasing organizations. Further, no employees, officers, directors, or representatives or agents of distributors or competing tool manufacturers are eligible to participate in the Program.If you complete a Demo or make a Qualifying Purchase, for or on behalf of your employer, then you agree to promptly deliver any Gift awarded under the Program to your employer, and to provide Sponsor evidence of such delivery upon request. Similarly, any Cash Rebate awarded under this Program will be made to the employer entity making the Qualifying Purchase. In addition, you are solely responsible for complying with your employer’s policies regarding acceptance of gifts and participation in promotions like this Program.

  3. Disclaimer

    Sponsor and each of its parent companies, subsidiaries, and affiliates, and their respective directors, officers, professional advisors, representatives, employees and agents (collectively, the “Released Parties”) will not be responsible or have any liability for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or purchase requests; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures beyond Sponsor or the Released Parties reasonable control; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond the reasonable control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion.

  4. Program Details.

    A. Gift on completion of Fluke Networks Demo:

    1. During the Program Period, request a Demo for any of the Qualifying Products of your choice by visiting https://www.flukenetworks.com/FiberTestingSolutions.
    2. A Fluke Networks specialist will make an appointment with you and conduct the Demo. Note that demos conducted without the presence of a Fluke Networks specialist are not considered under this Promotion.
    3. Upon the completion of the Demo, you will be eligible to receive one (1) Gift.
    4. The Fluke Networks specialist will register your Gift with Fluke, where you will be asked to provide the shipping information, including business name, business address, and contact details.

    5. The gift will be shipped to your business address within 30 days from the Demo.

      Customers are eligible for one (1) Gift during the entirety of the Program Period, regardless of the number of Demos completed.

      Gifts cannot be shipped to post office boxes, reshipping companies, or distributors. Gift requests are subject to further audit at Sponsor’s sole discretion, and if fraud or any failure to conform with these Terms & Conditions is identified by Sponsor, Sponsor in its sole discretion may render that Gift request void, in which case it will not be honored. Sponsor may require customers to provide additional proof of purchase, including, without limitation, physical carrier codes from packaging, product serial numbers, or proof of delivery.

    B. Cash Rebate on making a Qualifying Purchase:

    1. Make a Qualifying Purchase

      Following the Demo, you will receive a single-use Cash Rebate eligibility voucher in the form of a unique code number (“DealMaker Code”).

      Purchase a Qualifying Product within the Program Period, you will be eligible for a Cash Rebate as detailed below. The purchasing of the following product(s) constitutes “Qualifying Purchase(s)” and will entitle you to the following cash-rebate amount:

    2. Once your Qualifying Purchase is shipped and you receive the invoice, within 30 days from the date of the invoice, visit the claim form website link as provided in the email with your DealMaker Code. Follow the claim form instructions to claim the Cash Rebate and attach a copy of the Qualifying Product’s priced and dated invoice with the correct model names and item numbers of the Qualifying Product and the DealMaker Code.
    3. The fully completed Cash Rebate claim form should be submitted within 30 days from the receipt of the Qualifying Purchase’s invoice. Submissions received after this period are void and will not be processed. It is the responsibility of the customer (and not that of the Sponsor or the Sponsor’s distributors or resellers) to complete the Cash Rebate claim form.
    4. Sponsor shall verify the submitted claim forms and invoices. In case of discrepancies in the form and/or the invoice as provided by a customer, Sponsor shall provide the correct Cash Rebate to the customer. If Sponsor determines that the customer’s claim does not meet the terms and conditions or is otherwise ineligible, the customer will be informed accordingly.

    5. Sponsor or Sponsor’s partners will make a bank account transfer for the Cash Rebate amount specified above corresponding to the Qualifying Purchases indicated on the Claim Form and the invoice within 30 days from the receipt of the fully completed Cash Rebate claim forms. The Cash Rebate amount will be in the same currency as that used for the Qualifying Purchase.

      The DealMaker Code and the Cash Rebate are personal to the customer who has made the Qualifying Purchase and cannot be assigned to another party. A proof may be required that the bank account provided for the payment of the Cash Rebate is the corporate bank account of the customer who has made the Qualifying Purchase (such as copies of bank statements, VAT or other tax registration or tax return or other document, dependent on country). If such proof is requested and customer fails to submit this within the time period reasonably required for such submission, the customer will lose their right to claim the Cash Rebate.

      All costs, taxes, customs duties, fees, and expenses associated with a customer’s participation in the Promotion are the responsibility of the customer. Sponsor shall bear the wire transfer bank charges for transferring the cash rebate sum to the customer.

      A DealMaker Code may only be used with one invoice. However, if a DealMaker Code is used with a single invoice that shows two or more purchased Qualifying Products, the customer will be eligible to receive a Cash Rebate for each of those Qualifying Products. The DealMaker Codes and invoices cannot be aggregated or used more than once. Any other products on the invoice will not be considered for the purposes of this Promotion

  5. Release of Liability; Indemnification.

    Except where otherwise prohibited by law, by participating in the Promotion, you release and agree to indemnify and hold harmless each Released Party from any liability, obligation, injury, claim, suit, action, cost, expense, loss or damage of any kind, including any tax liability or loss of opportunity, whether direct, indirect, special or consequential, that may be imposed on, asserted against or incurred by such Released Party that arise out of or relate in any way to this Promotion or the incentives offered thereunder, including, but not limited to, where arising out of or relating to the following: (a) any technical difficulties or equipment malfunction (whether or not under Sponsor’s control); (b) any misdelivery, theft, unauthorized access or third party interference; (c) any entry or request under the Promotion that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Sponsor) beyond the reasonable control of Sponsor; (d) any damages due to the operation of a postal or courier service; (e) any tax liability incurred by participant; and (f) use or misuse of any discounted product or gift with purchase (except to the extent covered by any applicable product warranty).

  7. Miscellaneous.

    The Promotion and these Terms & Conditions will be governed, construed, and interpreted under the laws of the country of incorporation of Sponsor without applying any conflicts or choice of law provisions under such law that might refer the interpretation or any term thereof to the laws of any other jurisdiction. Participants are bound by these Terms & Conditions and by the decisions of Sponsor, which are final and binding in all respects. To the fullest extent permitted by applicable law, Sponsor reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to suspend or cancel the Promotion or any person’s participation in the Promotion should computer viruses, unauthorized human intervention or other causes beyond Sponsor’s reasonable control affect the administration, security or conduct of the Promotion, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of conducting the Promotion as planned, or for any other reason determined by Sponsor to be appropriate in its discretion. Participants who violate these Terms & Conditions, violate any law, rule, or regulation in connection with participation in the Promotion, tamper with the operation of the Promotion or any controller(s) offered hereunder, or engage in any conduct that is detrimental or unfair to Sponsor, the Promotion or any other participant (in each case as determined in Sponsor’s sole discretion) are subject to disqualification from participation in the Promotion.
